We are not liable for any loss or damage arising from your failure to keep your credentials secure.

3.3 Account Termination

We reserve the right to suspend or permanently terminate your account, at our sole discretion and without prior notice, if we believe you have violated these Terms or engaged in conduct that may harm the Platform, its users, or third parties.

4.1 Your Content

You retain all ownership rights to the tribute text, photographs, images, and other materials you submit to the Platform ("Your Content"). By posting Your Content, you grant Tail Wags Remembered a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, display, distribute, and adapt Your Content solely for the purposes of operating and improving the Platform and providing our services to you and other users.

4.2 Content Standards

All content submitted to the Platform must comply with our Content Guidelines. You agree not to post content that:

• Is false, misleading, defamatory, obscene, or offensive;
• Infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party;
• Contains viruses, malware, or any other harmful or disruptive code;
• Promotes hate speech, violence, harassment, or discrimination;
• Violates any applicable local, state, federal, or international law or regulation.

4.3 Content Moderation

All tributes and submitted content are subject to review before publication. We reserve the right, but are not obligated, to monitor, edit, or remove any content that we determine, in our sole discretion, violates these Terms or our Content Guidelines or is otherwise objectionable. We do not assume liability for any content that you or other users post on the Platform.

4.4 Our Intellectual Property

All content, design elements, graphics, logos, trademarks, software, and other materials on the Platform that are not Your Content are the exclusive property of Tail Wags Remembered or our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our intellectual property without our express written permission.

You agree to use the Platform only for its intended purpose of memorializing and celebrating beloved pets. In addition to the content restrictions above, you agree not to:

• Use the Platform for any commercial solicitation, spam, or unsolicited communications without our prior written consent;
• Attempt to gain unauthorized access to any part of the Platform, its servers, or any connected systems;
• Use automated scripts, bots, or scrapers to collect information from the Platform;
• Impersonate any person, entity, or organization; or
• Interfere with or disrupt the integrity, performance, or operation of the Platform.

The content, resources, community messages, tributes, and any other materials available on the Platform — including any articles, blog posts, or user-shared experiences relating to grief, loss, or coping — do NOT constitute and should NOT be interpreted as:

• Medical advice, diagnosis, or treatment of any kind;
• Mental health advice, counseling, therapy, or psychiatric treatment;
• A substitute for consultation with a licensed physician, psychologist, therapist, counselor, or other qualified healthcare professional; or
• A crisis intervention service.

Grief is a natural and healthy response to loss, but for some individuals, the loss of a pet can trigger or intensify serious mental health conditions, including depression, anxiety, and complicated grief. We strongly encourage you to seek the support of a qualified mental health professional, your primary care physician, or a licensed grief counselor if you are experiencing significant emotional distress.

Nothing on this Platform creates a patient-provider relationship, a therapist-client relationship, or any other professional healthcare relationship between you and Tail Wags Remembered or its team members.

The Platform may contain affiliate links to third-party products and services. • The results obtained from use of the Platform will be accurate, reliable, or meet your expectations.

To the maximum extent permitted by applicable law, Tail Wags Remembered, its officers, directors, employees, affiliates, agents, contractors, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to lost profits, loss of data, loss of goodwill, service interruption, or computer damage, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for all claims arising out of or related to these Terms or your use of the Platform exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability shall be limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Tail Wags Remembered and its officers, directors, employees, affiliates, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Tail Wags Remembered is registered, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Platform that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.

• A description of the copyrighted work;
• Identification of the infringing material and its location on the Platform;
• Your contact information;
• A statement of good-faith belief that the use is not authorized; and
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

The Platform is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at legal@tailwagsremembered.com and we will take steps to remove that information and terminate any associated account.

These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and Tail Wags Remembered with respect to your use of the Platform. If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of our right to enforce it in the future. No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Tail Wags Remembered.
